The property hereinabove described was acquired by Grantor by instrument recorded in Deed Book 228, at Page 481 of the Alamance County Registry. Commonly known as: 422 E Harden St, Graham, NC 27253 The sale will be held at the place where foreclosure sales are customarily held in the Alamance County Clerk located in, Graham, North Carolina. The Secretary of Housing and Urban Development will bid $120,652.31. There will be no proration of taxes, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his prorate share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale. When making their bids, all bidders except the Secretary must submit a deposit totaling $12,065.23 in the form of a certified check or cashier’s check made out to the Secretary of HUD. A deposit need not accompany each oral bid. If the successful bid is oral, a deposit of $12,065.23 must be presented before the bidding is closed. The deposit is nonrefundable. The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence. This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check. If the Secretary is the highest bidder, he need not pay the bid amount in cash. All extensions will be for 15-day increments for a fee of $500.00, paid in advance. The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due. If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the foreclosure commissioner after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder. There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the ACT. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the property will be vacant. The scheduled foreclosure sale shall be canceled or adjourned if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner not less than 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of services of this notice of default and foreclosure sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the property is completed. NOTICE OF SERVICE OF PROCESS
BY PUBLICATION
UPON PARENT
IN THE GENERAL COURT OF JUSTICE
DISTRICT COURT
DIVISION
FILE NO. 23 JA 11
STATE OF
NORTH CAROLINA
COUNTY OF ALAMANCE
IN RE: A.D.W.
DOB: 11/17/2022
TO: Bryana Nicole Cairo, Jeremy Paul Cairo, Biven Dean Wagner and Any Unknown Father
Respondent:
TAKE NOTICE that a petition has been filed alleging that the above-described juvenile is abused, neglected, and dependent.
That a petition has been filed by the Alamance County Department of Social Services. You are hereby notified to appear at 8:30 a.m. on the 22nd day of March, 2023, in Alamance County District Court for hearing on the Juvenile Petition filed on January 12, 2023 by the Alamance County Department of Social Services. The minor child is born to Bryana Nicole Cairo (white female, approximately 28 years of age) in Alamance County, North Carolina.
YOU ARE HEREBY SUMMONED TO APPEAR on the 22nd day of March, 2023, at 8:30 a.m. for a hearing on the petition. If the Court determines that the allegations of the petition are true, the Court will conduct a dispositional hearing to consider the needs of the juvenile and enter an order designed to meet those needs and the objectives of the State. The dispositional order may:
1. remove the juvenile from the custody of a parent, guardian, or custodian;
2. order the parent to pay child support if the child is placed with someone other than the parent;
3. place legal or physical custody of the juvenile with the parent on the condition that the parent undergo medical, psychiatric, psychological, or other treatment;
4. require that the juvenile receive medical, psychiatric, psychological, or other treatment and that the parent participate in the treatment;
5. require the parent to undergo psychiatric, psychological, or other treatment or counseling;
6. order the parent to pay for treatment that is ordered for the juvenile or the parent.
IF THE PROBLEMS SET FORTH IN THE JUVENILE PETITION ARE NOT CORRECTED WITHIN A REASONABLE TIME, OR OTHER GROUNDS ARISE UNDER G.S. 7B-1111, A MOTION IN THE CAUSE MAY BE FILED TO TERMINATE YOUR PARENTAL RIGHTS ENTIRELY. UPON PROPER NOTICE AND HEARING, THE COURT COULD TERMINATE YOUR PARENTAL RIGHTS.
YOU ARE HEREBY SUMMONED to appear at the time set for the hearing upon the petition. The court could determine that you are responsible for reimbursing the State for the fees of the guardian ad Litem or attorney advocate appointed to represent the juveniles. If the Court determines that you can and should pay, it may order you to reimburse the State for such fees. If you fail to appear, the Court may enter such an order in your absence.
You have the right to appear at any and all hearings. You have the right to be represented by a lawyer at all stages of this proceeding and may hire a lawyer immediately. A lawyer will be appointed to you if you cannot pay for one and if you ask to have one appointed. To obtain contact information, court dates and complete an affidavit of indigence, contact the office of the Clerk of Superior Court in Alamance County, at (336) 570-5325.
