Notice is hereby given that the City Council of the City of Graham, NC will hold a public hearing in the Council Chambers at Graham City Hall, 201 S. RESOLUTION FIXING DATE OF PUBLIC HEARING ON QUESTION OF ANNEXATION PURSUANT
TO G.S. 160A-31.C
WHEREAS, Staff had a pre-application conference with the property owner, Carl David Buckland, Trustee, of two properties addressed as 302 West Old Glencoe Road (PID 140413) and 0 West Old Glencoe Road (PID 174564) on December 21, 2022 to discuss a water and sewer connection to serve a commercial use on the property; and
WHEREAS, at that meeting on December 21, 2022 staff explained the Utility Request Connection process according to Section 40-40 of the City Code of Ordinances and the City of Burlington Utility Connection Request Procedures; and
WHEREAS, 302 West Old Glencoe Road (PID 140413) and 0 West Old Glencoe Road (PID 174564) is used for commercial purposes and includes a temporary office trailer used as an office; and
WHEREAS, said properties are contiguous to existing City corporate limits to the south; and
WHEREAS, the properties there are zoning and development controls in place since the parcels are zoned Conditional – Industrial (CI-607A) and are located within the Burlington Extraterritorial Jurisdiction; and
WHEREAS, according to Section 40-40 of the City’s Code of Ordinances and the City of Burlington Utility Connection Request Procedures, such utility requests located outside of the corporate limits must be considered by City Council and must accompany an annexation petition; and
WHEREAS, the property owner for the two properties addressed as 302 West Old Glencoe Road (PID 140413) and 0 West Old Glencoe Road (PID 174564) initiated a utility connection for a water and sewer connection to serve a commercial use dated March 10, 2023, which was forwarded to the Planning Department by the Engineering Department on March 22; and
WHEREAS, Staff is recommending the utility request be approved, since the property is located within the City’s ETJ, and there are zoning and development controls in place; and
WHEREAS, This area is not a distressed area and the City is not required to provide utility extensions. This is stand-alone voluntary annexation request and is within the City’s purview for consideration.
WHEREAS, Staff is recommending the utility connection and the annexation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Burlington, North Carolina that:
Section 1. A public hearing on the question of annexation of the area described herein will be held at the Municipal Building at 7:00 PM on Tuesday, May 16, 2023.
