NOW COMES the Plaintiff BSJD, LLC, and pursuant to North Carolina Rule of Civil Procedure 56, moves the Court to enter summary judgment on all claims for relief set forth in the Complaint against all the Defendants, against four (4) of whom default has been entered by this Court pursuant to Entries of Default entered on August 6, 2024, and August 28, 2024, as to Suzanne Amick, Jason Scott Oliver, Jonathan Brown and Kathy Clifton, respectively (collectively, the “Defaulted Defendants”). In addition, on August 22, 2024, James Hunt Johnson, Esq., as Guardian Ad Litem for the minor Defendant, filed an Answer and Report of Guardian Ad Litem for Minor Defendant, in which, among other assertions, all allegations and statements set forth in the Plaintiff’s Complaint were admitted as accurate and which stated to the Court that the Plaintiff’s civil action and requested relief of quiet title to the subject property are not opposed by the minor Defendant
In support of its Motion, the Plaintiff shows that, upon the verified pleadings and other documents and instruments in the record of this case, there is no genuine issue of material fact and the Plaintiff is entitled as a matter of law to a declaration and judgment quieting title to the Missing Property (as defined in the Complaint) that is the subject of this action as to the Defendants, their heirs, successors and assigns.
WHEREFORE, the Plaintiff moves for a declaration and judgment quieting the title to the Missing Property as to the Defendants, their heirs, successors and assigns, SO MOVED this the day of 2024.
